About these terms
These Terms and Conditions govern your use of the Cape Town Local website at bloubergstrand.co.za (the "site"). Cape Town Local is operated by a South African sole trader trading as Cape Town Local. In these terms, "we", "us" and "our" refer to Cape Town Local, and "you" refers to anyone who visits or uses the site.
Cape Town Local is a hyper-local content and business directory for Cape Town, including editorial articles, a local news section and paid business listings. By accessing or using the site, you agree to be bound by these terms. If you do not agree, please do not use the site.
Who may use the site
You may use the site if you are at least 18 years old, or if you have the consent of a parent or guardian and are old enough to enter into a binding agreement under South African law. By using the site you confirm that you meet these requirements and that any information you give us is accurate.
Accounts and login security
Some features, such as claiming or managing a business listing, require an account. You are responsible for keeping your login details confidential and for all activity under your account. Please tell us promptly at [email protected] if you believe your account has been accessed without your permission. We may suspend or close an account that is used in breach of these terms.
Acceptable use
When using the site, the directory and the news section, you agree not to:
- break any applicable South African law or infringe anyone's rights;
- post content that is unlawful, defamatory, misleading, discriminatory, harassing or obscene;
- submit false, spammy or fraudulent listings, reviews or enquiries;
- attempt to gain unauthorised access to the site or interfere with its operation; or
- scrape, copy or harvest content or data except as ordinary browsing allows.
User-submitted content and the licence you grant us
You keep ownership of content you submit to the site, such as listing details, images, reviews and enquiries. By submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to host, store, display, adapt for formatting and promote that content as part of operating and marketing the site. You confirm that you have the right to submit the content and to grant this licence, and that the content does not infringe anyone else's rights.
Intellectual property
The site, its design, text, graphics, logos and editorial articles are owned by us or our licensors and are protected by South African and international intellectual property laws. You may view and share links to our content for personal, non-commercial use. You may not reproduce, republish or exploit our content commercially without our written permission, except where the law allows.
Paid business listings
Paid business listings are offered in a Free tier and a Premium tier and are governed by the separate Business Listing Agreement, which applies in addition to these terms. Where the two documents conflict on listing matters, the Business Listing Agreement prevails.
Third-party links
The site contains links to third-party websites and businesses. We do not control and are not responsible for the content, products, services or privacy practices of those third parties. Links are provided for convenience only and do not imply our endorsement.
Disclaimers
The site and its content are provided on an "as is" and "as available" basis. While we work to keep listings, news and articles accurate and current, we do not warrant that the site will be uninterrupted, error-free or free of inaccuracies. Directory listings are supplied by business owners or compiled from public sources, and you should verify details directly before relying on them.
Limitation of liability
To the extent permitted by law, we are not liable for any indirect, incidental or consequential loss arising from your use of the site or your reliance on its content. Nothing in these terms limits any liability that cannot lawfully be limited.
Indemnity
You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these terms, your content, or your unlawful use of the site.
Your consumer rights
Nothing in these terms excludes, limits or waives any right you have under the Consumer Protection Act 68 of 2008 or other South African law that cannot lawfully be excluded. These terms must be read subject to those rights.

Governing law and disputes
These terms are governed by the laws of the Republic of South Africa. If a dispute arises, we ask that you first contact us so we can try to resolve it. Failing that, the dispute falls under the jurisdiction of the courts of the Western Cape, South Africa.
