What this agreement covers
This Business Listing Agreement governs how you list a business on Cape Town Local at bloubergstrand.co.za. It applies in addition to our Terms and Conditions. By creating, claiming or paying for a listing, you accept this agreement. In it, "we", "us" and "our" mean Cape Town Local, operated by a South African sole trader trading as Cape Town Local, and "you" means the person or business listing on the site.
Eligibility and claiming a listing
To list or claim a business you must be the owner of that business or be authorised to act on its behalf, and you must give accurate details. Some listings may already exist from public sources; claiming a listing links it to your account so you can manage it. We may ask for reasonable proof of ownership before granting control of a listing.
The Free and Premium tiers
We offer two listing tiers:
- Free: a basic listing in the directory with core business details, at no charge.
- Premium: an enhanced listing with additional features and greater visibility, offered as a paid recurring subscription.
The exact features of each tier are described on the site and may be improved over time.
Fees and recurring billing
The Premium tier costs R200 per month or R2000 per year, as you choose at sign-up. Premium is a recurring subscription: the fee is charged automatically at the start of each billing period through our payment provider, PayFast, using the payment method you provide, and it continues until you cancel. By subscribing, you authorise these recurring charges. We do not store your full card details; these are handled securely by PayFast. We will give reasonable notice of any change to the fees.
Your listing content
You are responsible for the accuracy, legality and currency of the content in your listing, including descriptions, images, contact details, prices and offers. You confirm that you have the right to use that content and that it does not infringe anyone else's rights or mislead consumers.
The licence you grant us
By submitting listing content, you grant us a non-exclusive, royalty-free licence to host, display, format and promote that content as part of the directory and our marketing of the site, for as long as the listing is live and for a reasonable period afterwards for archival and record purposes.
Moderation and removal
We may review, moderate, edit for formatting, suspend or remove any listing that breaches this agreement, our Terms and Conditions or our Advertising Guidelines, that is unlawful or misleading, or that is the subject of a valid complaint. Where practical we will let you know, but we may act immediately where the law or a serious risk requires it.
Renewals, cancellation and refunds
Premium subscriptions renew automatically at the end of each billing period unless cancelled before the next renewal date. You can cancel future renewals through your account or by emailing [email protected]. Cancelling stops future charges; it does not automatically refund charges already made. Refunds, where they apply, are dealt with under our Refund Policy.
Warranties and disclaimers
We provide the listing service on an "as is" and "as available" basis. We do not guarantee any particular level of enquiries, traffic, leads or business outcomes from a listing, and the directory is provided without warranties beyond those that cannot lawfully be excluded.
Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential loss arising from your listing or your use of the service. Nothing in this agreement limits any liability or consumer right that cannot lawfully be limited, including rights under the Consumer Protection Act 68 of 2008.
Term and termination
This agreement applies for as long as you have a listing on the site. You may end it by removing your listing and cancelling any subscription. We may suspend or end your listing for breach of this agreement or our other policies. On termination, the licence you granted continues only to the limited archival extent described above.
Governing law
This agreement is governed by the laws of the Republic of South Africa, and disputes fall under the jurisdiction of the courts of the Western Cape. For any questions, contact us at [email protected].
